Sourcer Term Sheet

The following terms and conditions (“Term Sheet”) apply to the Sourcer resume search service (“Sourcer Service”) and are incorporated by reference into the applicable Service Order and form part of the Agreement with the Client, along with JobTarget’s General Terms and Conditions, Terms of Use and Privacy Policy, as set forth in the Service Order. This Term Sheet further applies to the purchase of the Sourcer Service through JobTarget’s website. JobTarget may modify these terms at any time. By continuing to use JobTarget’s services, you are agreeing to any such modified terms.

Acceptable Use

This service shall not be used:

  • For any purpose other than identifying and connecting with individuals related to job opportunities. Any other use is strictly forbidden.
  • To contact candidates about anything other than legitimate and current job openings.
  • To contact candidates for any types of illegal services or jobs which require any type of payment from the candidate.
  • To send emails or text messages or make phone calls to candidates that are excessive in frequency or unrelated to job openings or to candidates who have indicated that such communications are unwanted.
  • In any discriminatory, biased, illegal or fraudulent manner or otherwise not in accordance with applicable laws and regulations.


  • Client may not download data from this Service, except if given specific approval by a particular candidate and may only be done using a specified “data download” tool provided by JobTarget. Scraping, copying, and other methods of collecting data are strictly prohibited.
  • Any downloaded data may not be given to any third party.
  • Data must be held confidential and stored in a secure method, equal to methods Client uses to secure its own confidential data.
  • The data must be used in compliance with applicable privacy and data protection laws.
  • If Client suffers a data breach which includes any data downloaded from JobTarget, Client must notify JobTarget in writing within three (3) business days of discovery of the breach and provide as much detail as possible, including, but not limited to which users’ data may have been compromised.

Contacting Candidates

  • Client may only contact candidates using the contact methods offered within the Sourcer Service. Identifying candidates within the service and then using outside means not provided by JobTarget to contact the candidate is strictly forbidden.
  • If a candidate requests that Client cease contacting them, Client agrees to no longer reach out or communicate with the candidate.
  • Client shall refrain from using any unprofessional, derogatory, insensitive, racist, sexist, or other types of potentially offensive language when using JobTarget’s communication tools.

Additional Terms

  • JobTarget reserves the right in its sole discretion to restrict Client’s access or use of JobTarget’s services.
  • Client acknowledges that JobTarget owns the rights to the data provided to Client within the Sourcer Service.
  • By using the Sourcer Service, you are agreeing to allow JobTarget to share Client’s users’ names, titles, and possibly other information, as controlled in the JobTarget Settings App, with the candidate.
  • If Client uses the Sourcer Service to search resumes from other third-parties, Client agrees that they have acquired the proper licenses and have agreed to any additional terms those third-party vendors may have in providing the service.
  • JobTarget makes no representations or warranties with respect to the Sourcer Service, the data accessed and/or Client’s use thereof, including but not limited to whether Client will receive desirable or satisfactory results from use of the Sourcer Service. Such use shall be at Client’s sole risk.
  • Information contained in resumes is self-reported by candidates, is not verified by JobTarget and may be inaccurate or outdated. The appearance of a resume in search results is not a guarantee that the candidate has the attributes or experience selected in the search or that the candidate will be interested in the job.
  • JobTarget may update, modify or discontinue the Sourcer Service at any time in its sole discretion without liability to Client.
