Job Hosting & Job Application Systems/Services Terms & Conditions

This Term Sheet is incorporated into the Agreement between JobTarget and the Client identified in the Service Order to which this Term Sheet is attached, if one exists. In absence of a Service Order, this Term Sheet is incorporated into JobTarget’s Online Agreements and Terms of Use.

Hosting Jobs

Clients that add their job opening into JobTarget or have their job advertisements posted in the public domain grant JobTarget the right to host versions of those jobs on JobTarget’s platform. JobTarget may alter formatting as needed, but will not alter the copy, except to shorten or summarize. Client may request JobTarget to remove hosted content, upon written request. Client understands that JobTarget is only responsible for removing content it hosts on its own servers.

Easy Apply

Many job sites, including, but not limited to Indeed.com, ZipRecruiter, and Linkedin, offer job seekers the means to apply for jobs directly on the job board. JobTarget may support these apply methods on behalf of the Client. In doing so, JobTarget may collect, process, and store data including, but not limited to, the apply forms the Client uses, as well as the job applications submitted by the job sites and job seekers. These job applications may include resumes, cover letters, answers to job application questions, EEOC data, and other Personal Identifiable Information (PII). JobTarget and Client shall use commercially reasonable efforts to protect such data from unauthorized access. Client understands that job seekers retain ownership and control of their information. While Client retains rights to Client’s content, subject to licenses granted to JobTarget, and may access information submitted by job seekers in response to Client’s job applications, job seekers can select to share the same information with other employers, including through JobTarget’s platform.

Hosted Apply

In certain cases, JobTarget shall directly collect the job application information from the job seeker. In doing so, JobTarget may collect, process, and store data including, but not limited to, the apply forms the Client uses, as well as the job applications submitted by the job sites and job seekers. JobTarget may collect the job application questions directly from the Client or their ATS provider. JobTarget shall make commercially reasonable efforts to ask the questions as intended. There may be cases where that is not possible given the automated nature of the systems used. JobTarget may alter formatting as needed, but will not alter the copy, except to shorten or summarize. These job applications may include resumes, cover letters, answers to job application questions, EEOC data, and other Personal Identifiable Information (PII). JobTarget and Client shall use commercially reasonable efforts to protect such data from unauthorized access. Client understands that job seekers retain ownership and control of their information. While Client retains rights to Client’s content, subject to licenses granted to JobTarget, and may access information submitted by job seekers in response to Client’s job applications, job seekers can select to share the same information with other employers, including through JobTarget’s platform.

Additional Terms

  • JobTarget reserves the right to share job application statuses with job seekers, including, but not limited to, whether their job application was viewed, its current status, and whether they were declined.
  • JobTarget reserves the right to restrict your access or use of JobTarget’s services, solely in its own discretion, which it may change at any time.
  • Client acknowledges that JobTarget owns all rights to the service.
  • Client agrees to only use third-party content and PII obtained through JobTarget’s services for the purposes represented by Client to JobTarget.
  • By using this Service, you are agreeing to allow JobTarget to share Client’s users’ name, title, and possibly other information, as controlled in the JobTarget Settings App, with the candidate and as otherwise outlined by applicable terms and our privacy policy.
  • JobTarget makes no representations or warranties with respect to the service, the data collected or accessed by the Service and/or Client’s use thereof. Such use shall be at Client’s sole risk.
  • Without limiting the generality of any disclaimers in this Term Sheet or any other agreements relating to this service, JobTarget may take, in its sole discretion (but is not obligated to take) any steps to enforce any provisions herein and therein, including, without limitation, taking any steps to collect any fees beyond invoicing the responsible party.
  • This Term Sheet shall be subject to and governed by the terms of the applicable Service Order, Online Agreements, and/or Terms of Use, including related to dispute resolution, indemnification, disclaimers, limits of liability, waiver, and other provisions. This Term Sheet is subject to any applicable laws and is expressly severable.
