The following terms (“Term Sheet”) apply to JobTarget’s Apply Systems products, including but not limited to Easy Apply, Hosted Apply, Candidate Manager, Messaging, organic job postings, and JobTarget job postings, (“Apply Products”) and are incorporated by reference into the applicable Service Order and form part of the Agreement with the Client, along with JobTarget’s General Terms and Conditions, Terms of Use and Privacy Policy, as set forth in the Service Order. This Term Sheet further applies to products and services purchased through JobTarget’s website. Any capitalized terms have the definitions provided in the Terms of Use. JobTarget may modify these terms at any time. By continuing to use JobTarget’s services, you are agreeing to any such modified terms.   

Easy Apply

Many job sites, including, but not limited to Indeed.com, ZipRecruiter, and LinkedIn offer job seekers the ability to apply for jobs directly on the job site. Depending on the functionality of the Client’s Applicant Tracking System (“ATS”) and the particular job site, JobTarget may support these direct apply methods on behalf of the Client through JobTarget’s Easy Apply, an Application Programming Interface (API). In some cases, the ATS may automatically set the Client’s job postings as Easy Apply jobs. By using JobTarget’s services, Client agrees that JobTarget may activate the Easy Apply function for Client’s job postings. When a job posting is set to Easy Apply, JobTarget may collect, process, and store data including, but not limited to Client’s apply forms and questionnaires, and job applications submitted by the job sites and job seekers. These job applications may include resumes, cover letters, answers to job application questions, EEOC data, and other Personal Identifiable Information (PII). JobTarget may also parse the applicant’s resume for data to be provided to Client. Client agrees to use commercially reasonable efforts to protect such data from unauthorized access. Client understands that job seekers retain ownership and control of their information and that job seekers can select to share their information with JobTarget and other employers, including through JobTarget’s platform. 

Hosted Apply

In certain cases, JobTarget may host a webpage on behalf of the Client for the direct collection of job application information from the job seeker through JobTarget’s Hosted Apply, which may include job application questions provided by the Client or through the Client’s ATS provider. In some cases, and depending on the job board, the ATS or JobTarget may automatically set the Client’s job postings to be sent to Hosted Apply. By using JobTarget’s services, Client agrees that JobTarget may activate the Hosted Apply function for Client’s job postings.  When a job posting is set to Hosted Apply, JobTarget may collect, process, and store data including, but not limited to Client’s apply forms and questionnaires, and job applications submitted by the job sites and job seekers. JobTarget shall make commercially reasonable efforts to display content and job application questions on behalf of the Client as intended. There may be cases where that is not possible given the automated nature of the systems used. JobTarget reserves the right to alter formatting as needed and may shorten or summarize content or modify job apply forms, including the addition or deletion of content, instructions, or data inputs.  The job applications received may include resumes, cover letters, answers to job application questions, EEOC data, and other Personal Identifiable Information (PII). JobTarget may also parse the applicant’s resume for data to be provided to Client. Client agrees to use commercially reasonable efforts to protect such data from unauthorized access. Client understands that job seekers retain ownership and control of their information and that job seekers can select to share their information with JobTarget and other employers, including through JobTarget’s platform. Client may request in writing that JobTarget remove hosted content. Client understands that JobTarget is only responsible for removing content it hosts on its own servers. 

Candidate Manager 

Clients may review applications processed through Easy Apply or Hosted Apply using Candidate Manager on the JobTarget Platform. Candidate Manager provides tools and features to assist Employers with the review of job applicantswhich may include the use artificial intelligence and machine learning models, including third party models and systems, to identify candidates based on Employer job descriptions, requirements and application questions 

JobTarget may flag or remove applications that appear to be fraudulent, completed by bots or otherwise not complete. JobTarget may also flag or identify candidates based on a candidate’s activity or other indicators.  Client agrees that it will not make decisions or depend solely upon such flags or identifications to make decisions that may produce legal or similar significant effects on job applicants. 

Messaging

The following terms apply to Customer’s use of the Messaging feature: 

Messaging shall not be used: 

  • For any purpose other than communicating and connecting with individuals relating to job opportunities. Any other use is strictly forbidden;
  • To contact job seekers and candidates about anything other than legitimate and current job openings;
  • To contact job seekers and candidates for any types of illegal services or jobs which require any type of payment from the job seeker or candidate;
  • To send messages, emails or text messages or make phone calls to job seekers or candidates that are excessive in frequency or unrelated to job openings or to job seekers or candidates who have indicated that such communications are unwanted. Messaging is not intended to be used to send bulk messages;
  • To send messages that are unprofessional, derogatory, insensitive, racist, sexist, or use other types of potentially offensive language; or
  • In any discriminatory, biased, illegal or fraudulent manner or otherwise not in accordance with applicable laws and regulations. 

JobTarget may indicate whether a message has been received or read. JobTarget may communicate directly with a job seeker about messages through email, text messaging or by phone. JobTarget makes no guarantees that a party will receive all messages and communications or that messages and communications will be free from error or displayed correctly. 

Additional Terms

  • When a job seeker submits information through the Apply Products, the job seeker may become a registered user in JobTarget’s platform. JobTarget reserves the right to communicate with a job seeker who submits information through the Apply Products, which may include communications on behalf of the Client or relating to other jobs.  JobTarget further reserves the right to use job seeker data in connection with other JobTarget services and products. 
  • JobTarget reserves the right to share job application statuses with job seekers, including, but not limited to, whether their job application was viewed, its current status, and whether it was declined.  
  • Client agrees that JobTarget is not an agent of Client or an employment agency by providing Apply Products. Client further agrees that Apply Products are not decision-making systems and Client will not use it as such. In providing the Apply Products, JobTarget does not have or accept authority to act or make employment decisions on Client’s behalf. The Apply Products cannot be used to make decisions, determinations or automated decisions without human review that may produce legal or similar significant effects on job applicants. Client is solely responsible for Client’s screening and hiring decisions.  
  • Client is responsible for providing accommodations for individuals with disabilities or alternative methods of screening, including application review that does not employ Artificial Intelligence, if required by applicable laws and regulations. 
  • Client is responsible for its own compliance with applicable recordkeeping laws and regulations. JobTarget does not guarantee storage or any information, except as provided in connection with specific services. 
  • Client acknowledges and agrees that JobTarget may also distribute its active or public jobs to additional sites, including those controlled by JobTarget, in JobTarget’s discretion to further advertise Employer’s jobs. It is possible that certain sites may redistribute job postings to other sites.  
  • It is possible that a job posting may remain posted beyond the set time or after it has expired or been closed. 
  • JobTarget is not responsible for the formatting or appearance of a job posting or for data transcribing errors. JobTarget further makes no guarantees that job applications will be complete, accurate or from real applicants.
  • Information provided by candidates is self-reported and is not verified by JobTarget, unless otherwise stated. JobTarget is not responsible for any inaccurate or false information provided by a job applicant or for content, communications or applications that are fraudulent or generated by bots.   
  • Client represents and warrants that its job postings, application questions and content comply with all applicable laws and regulations and that its job postings do not violate applicable laws, including Title VII of the Civil Rights Act, the Equal Employment Opportunity Commission’s (“EEOC”) regulations, and local, state, federal or other laws prohibiting discrimination of applicants, including but not limited to through the use of artificial intelligence, and/or requiring pay transparency.  Client further represents and warrants that its job postings will not violate the rights of any third parties, including, but not limited to, infringement of any copyright, trademark, or other proprietary right, false advertising, or defamation. 
  • If Client includes voluntary self-identification questions for job seekers along with the application materials, Client is solely responsible for compliance with applicable laws related to such questions, including the content and format of the questions and client’s use of job seeker responses.  
  • JobTarget reserves the right to modify or  remove any content, including application questions, posted by Client if required by JobTarget or a third-party site, if it violates JobTarget’s or a third-party site’s policies,  or to restrict Client’s access or use of JobTarget’s services in its sole discretion.  
  • Client represents and warrants that it will use job applicant content and PII obtained through JobTarget’s services solely for the purposes represented by Client to JobTarget.  
  • By viewing, sending, receiving, or storing communications, documents, and information (“Data”) through Messaging or on JobTarget’s Website or Services, Client agrees that such Data may be collected, processed, analyzed, reviewed and stored by JobTarget and/or its third-party vendors for analysis, quality control and performance, operation or improvement of the product and services, content moderation, or enforcement of JobTarget policies or terms, which may include the use of automation, artificial intelligence or machine learning to perform such functions.    
  • Client agrees that its use of Data must be in compliance with applicable privacy and data protection laws. 
  • By using this Service, you are agreeing to allow JobTarget to share Client’s users’ names, titles, and possibly other information with the job applicant. Such information sharing can be as controlled in the JobTarget Settings App and as otherwise outlined by applicable terms and our Privacy Policy. 
  • JobTarget makes no representations or warranties with respect to the Apply Products, the data collected or accessed by the Apply Products, and/or Client’s use thereof. Such use shall be at Client’s sole risk.
