The following terms and conditions (“Term Sheet”) apply to the AI Interviewer product and features (“AI Interviewer”) and are incorporated by reference into the applicable Service Order and form part of the Agreement with the Client and Users of JobTarget’s services and websites, along with JobTarget’s General Terms and Conditions, Terms of Use and Privacy Policy. JobTarget may modify these terms at any time. By continuing to use JobTarget’s services, you are agreeing to any such modified terms.

Services

The AI Interviewer allows the Client to conduct virtual audio or video recorded interviews by presenting questions to job applicants (“Applicants”). The AI Interviewer transcribes the Client’s questions from text to speech and transcribes the Applicant’s responses from speech to text. 

Client Responsibilities 

  • Client is responsible for preparing the interview questions and for ensuring that all questions asked comply with any applicable laws and regulations and are not unprofessional, discriminatory, or use other types of potentially offensive language.
  • Client will use the AI Interviewer solely for interviewing Applicants for legitimate and current job opportunities and will not use the AI Interviewer to contact Applicants for any type of illegal services or jobs that require any payment from the Applicant.
  • Client acknowledges that JobTarget is solely a technology platform provider and does not participate in the interview, evaluation, selection or hiring of Applicants and accordingly, Client is solely responsible for Client’s compliance with any applicable laws and regulations in connection with Client’s use of the AI Interviewer and/or JobTarget’s services or websites and Client’s recruitment and hiring of Applicants.
  •  Client is solely responsible for providing Applicants with the ability to request an accommodation due to a disability if required and for responding to any such Applicant request for accommodation. JobTarget does not represent, warrant or guarantee that the AI Interviewer or any of its services or websites meet accessibility needs. 

Data

  • By viewing, sending, receiving, or storing communications, documents, recordings and information (“Data”) through the AI Interviewer or JobTarget’s website or services, Client agrees that such Data may be collected, processed, analyzed, reviewed and stored by JobTarget and/or its third-party vendors for analysis, quality control and performance, operation or improvement of the product and services, content moderation, or enforcement of JobTarget policies or terms, which may include the use of automation, artificial intelligence or machine learning to perform such functions, in accordance with JobTarget’s Privacy Policy .    
  • Client agrees that Applicant interviews, recordings and transcriptions conducted through AI Interviewer or JobTarget’s website or services (“Applicant Data”) are private and confidential information and will not share, publish or distribute such Applicant Data beyond Client’s organization and will use Applicant Data solely for the purposes of evaluating applicants for employment.
  • Client use of Data and Applicant Data must be in compliance with applicable privacy and data protection laws.

Artificial Intelligence 

The AI Interviewer uses features powered by artificial intelligence, automation, and/or machine learning technologies (collectively, “AI”), which may be provided by third-party providers or incorporate systems maintained by third-party providers. Client acknowledges that AI-generated outputs may not be free from bias, inaccuracies, or errors. AI generated outputs should be reviewed, including human review where appropriate, prior to any reliance upon or decision-making. Client is solely responsible for ensuring its use of AI tools complies with applicable employment, anti-discrimination, and privacy laws. You agree that your inputs and content generated by AI in response to your inputs are considered Content as defined in the Agreement and JobTarget’s terms and conditions. AI generated output is provided “as is” and JobTarget makes no warranty or guarantee that AI generated output is appropriate, accurate, inoffensive, unbiased, non-infringing, legal, or safe, and disclaims all liability for AI generated output. Client agrees to defend, hold harmless and indemnify JobTarget from any claim arising from Client’s use or misuse of AI generated content or AI features.

Disclaimers

  • The AI Interviewer is provided “as is” and JobTarget makes no representations or warranties with respect to the AI Interviewer and/or Client’s use thereof, including but not limited to whether Client will receive desirable or satisfactory results from use of AI Interviewer.
  • JobTarget makes no guarantees that all interviews will be successfully or fully completed or that the recordings or transcripts will be free from error, accurate or displayed correctly.
  • JobTarget does not verify the identity of applicants or screen applicants or the interviews recorded through AI Interviewer. JobTarget is not liable for applicants or interviews that are fraudulent, inappropriate or offensive.

Additional Terms

  • JobTarget reserves the right to disclose to Applicants information about their interviews, including but not limited to whether their interviews were received or viewed by Client.
  • Interview recordings and transcripts will be stored for one year from the date of recording. After this period, interview recordings and transcripts may be deleted without further notice. Client may download interview data prior to deletion.
