This is a high-impact legal and compliance leadership role at the intersection of health care, telehealth, pharmacy, and digital health regulation.
You will serve as the primary internal authority on healthcare regulatory matters while building and operating a comprehensive compliance program.
The role combines legal advisory work with hands-on program development across a complex, multi-state care delivery model.
You will partner closely with clinical, pharmacy, product, engineering, growth, operations, and people teams to enable compliant business growth.
The position requires strong judgment, commercial fluency, and the ability to translate evolving regulations into practical guidance and clear action plans.
You will also help safeguard professional entity structures, patient safety, privacy, prescribing practices, and clinical independence.
This largely autonomous role offers broad ownership and the opportunity to shape the evolution of legal and compliance functions within a growing digital health environment.

• Build and operate a comprehensive healthcare compliance program aligned with the seven elements of an effective compliance program and current OIG guidance, including policies, SOPs, training, reporting, investigations, risk assessments, monitoring, auditing, and annual work plans.
• Own the legal integrity of the PC-MSO structure across all states of operation, addressing corporate practice of medicine, fee-splitting, professional entity governance, and limits on non-clinical control of clinical decision-making.
• Draft and update management services agreements, administer affiliated professional entities, train non-clinical leaders on appropriate operating boundaries, and coordinate state MSO transparency and transaction-notification requirements.
• Advise product, clinical, growth, engineering, and operations teams on new products, care models, protocols, pricing, and expansion initiatives, helping teams identify compliant paths forward.
• Maintain state-by-state telehealth regulatory matrices, legal position papers, and risk registers while translating legislative and enforcement developments into prioritized actions.
• Advise on clinician licensure, interstate compacts, scope of practice, supervision requirements, credentialing, peer review, clinician contracting and compensation, adverse events, board complaints, and NPDB matters.
• Lead regulatory guidance on the Ryan Haight Act, DEA telemedicine prescribing requirements, state prescribing rules, pharmacy relationships, 503A/503B compounding, and FDA-regulated promotional and software considerations.
• Oversee privacy and data compliance covering HIPAA, state consumer health data laws, FTC Act Section 5, tracking technologies, breach assessments, OCR reporting, business associate agreements, TCPA, CAN-SPAM, and AI governance.
• Review marketing claims, testimonials, influencer and affiliate arrangements, website terms, consent flows, and auto-renewal practices for healthcare and consumer protection compliance.
• Advise on referral relationships, patient acquisition channels, discount and waiver programs, and clinician and sales compensation to manage fraud and abuse risks.
• Draft and negotiate healthcare-regulated contracts, support state expansion and go-live approvals, and serve as a primary legal contact for regulators and government agencies when required.
• Manage relationships with external healthcare regulatory counsel and other legal vendors.

Requirements:

• J.D. degree and active bar membership in good standing in at least one U.S. jurisdiction, with eligibility to serve as in-house counsel in Nevada.
• 6–8+ years of healthcare regulatory experience gained at a leading healthcare regulatory practice, AmLaw healthcare group, or in-house within a provider, digital health, or payer organization.
• Direct, hands-on experience with PC-MSO or friendly-PC structures, including building, documenting, defending, or operating these arrangements.
• Strong command of corporate practice of medicine, fee-splitting, telehealth practice and modality requirements, multi-state licensure, HIPAA, and state medical board regulation.
• Experience developing or materially contributing to a healthcare compliance program.
• Working knowledge of healthcare fraud and abuse laws and guidance, including the Anti-Kickback Statute, Stark Law, EKRA, CMP Law, False Claims Act, OIG guidance, and exclusion screening.
• Strong knowledge of healthcare privacy, prescribing, pharmacy, controlled substances, consumer health data, and digital health regulatory requirements.
• Experience navigating DEA telemedicine prescribing and controlled substance workflows is preferred.
• Digital health experience during periods of multi-state expansion is preferred.
• Experience with state MSO oversight, ownership transparency, and transaction-notification regimes is a plus.
• Prior experience as a Chief Compliance Officer or Privacy Officer is valued.
• Experience handling government investigations, medical board inquiries, or OCR matters is advantageous.
• Strong business judgment and the ability to provide clear, decisive, risk-calibrated recommendations rather than simply identifying legal considerations.
• Excellent written and verbal communication skills, with the ability to translate complex legal requirements into practical guidance for non-lawyers.
• Ability to work autonomously, build programs from the ground up, collaborate across functions, and maintain appropriate regulatory and patient-safety boundaries.
• Strong credibility with clinical stakeholders and the confidence to challenge senior leadership when legal, structural, or patient-safety considerations require it.
