Position Type/Expected Hours of Work:

This is a full-time, managerial position, and the days of work and hours are Monday through Friday, 8:30 a.m. to 4:30 pm. Note: This position is in the “NL” category of employment (non-fixed work week) and individuals in this role have no claim or entitlement to time off or cash compensation for hours worked beyond their normal schedule. Occasional evening and weekend work may be required as job duties demand. It is the policy of the College to grant hour-for-hour compensatory time off, with advance approval, only when employees are required to work on a holiday. Time earned must be used within one fiscal year from the time it is earned.

JOB SUMMARY:

The Associate Director of Equal Opportunity and Deputy Title IX Coordinator serves as the College's Affirmative Action/Equal Employment Opportunity (AA/EEO) Officer and lead investigator. Reporting to the Director of Title IX and Institutional Compliance, the Associate Director will play a significant role in supporting compliance with federal, state, and College affirmative action and equal employment opportunity laws, policies, regulations and related statutes including: the New Jersey State Policy Prohibiting Discrimination in the Workplace and related provisions of the New Jersey Administrative Code, Titles VI and VII of the Civil Rights Act, and Title IX of the Educational Amendments Act of 1972 (“Title IX”). The Associate Director works closely with senior administrators, advises on complex employee and student matters, and plays a central role in promoting fair, equitable, and legally compliant processes across the College.

Examples of Duties

DUTIES/RESPONSIBILITIES:

Serves as AA/EEO Officer:

  • Monitors compliance with AA/EEO laws, policies, regulations, and programs, and works with various campus constituencies to facilitate an understanding of how to apply these policies and programs to daily actions, behaviors, and decisions. Responsible for the investigation and resolution of student and employee Title VII and state discrimination, harassment, and hostile work environment complaints.
  • Prepares detailed reports of investigations in a timely manner and makes recommendations on dispositions to the President or the President’s designee in accordance with the New Jersey State Policy Prohibiting Discrimination in the Workplace.Partner with the Department of People Operations and Employee Resources (POER) to monitor the College’s recruitment, selection, and employment policies, including review of search committee composition and applicant pool analysis.
  • Serve as the Affirmative Action Representative on college-wide faculty committees related to the Tenure, Promotion, Career Development, Faculty Scholarship Fund, Sabbaticals processes, and Professional Staff Promotion.
  • Oversees college-wide distribution of the New Jersey Policy Prohibiting Discrimination in the Workplace on an annual basis in compliance with New Jersey state regulations and statutory mandates.
  • Serves as the College's AA/EEO liaison to state and federal agencies. Attends statewide bimonthly AA/EEO Officers’ Meetings. Responsible for federal and state reporting requirements and related statistical analysis.
  • Oversees implementation and monitoring of the College’s Workforce Development Plan in partnership with the New Jersey Civil Service Commission. Reviews workforce analyses and statistical reports regarding recruitment, hiring, and other employment actions to monitor AA/EEO compliance.

Serves as the Deputy Title IX Coordinator, including:

  • Serves as a Title IX Investigator on an as-needed basis.
  • Preside over the Title IX hearing process on an as-needed basis as the Hearing Chair, including review of investigative reports, analyzing witness statements, and making recommendations on dispositions, including recommending sanctions as appropriate.
  • Effectively manages the duties of the Title IX Coordinator in their absence.

Case Management:

  • Ensures case management data and documentation of outreach, interim and support measures, and all reports are up-to-date and maintained accurately.
  • Provides monthly updates regarding case resolution, trends, and case management status.
  • Collaborating with on- and off-campus resources, support services, and law enforcement in resolving complaints;
  • Safeguards the confidentiality of information and exercises discretion with confidential information.

Additional Responsibilities:

  • Assists with policy review and development as needed to enhance the College’s compliance framework.
  • Establishes and maintains effective communication and cooperative working relationships with college administrators, faculty, and staff, and builds rapport with students from a wide array of identities, backgrounds, and experiences.
  • Contributes to the overall success of the Office by performing other duties as assigned by the Director of Title IX and Institutional Compliance.
  • Supports the mission of the College and the Strategic Plan.
Qualifications

REQUIREMENTS

EDUCATION

  • Master’s degree in higher education, law, human resources, public administration, or a closely related field; or a Juris Doctor (J.D.) from an accredited institution.

EXPERIENCE

  • Five years of experience conducting workplace, AA/EEO, Title IX, employee relations, or related compliance investigations. A Ph.D. or an Ed.D. degree may be substituted for two years of the required experience.
  • Demonstrated knowledge of AA/EEO or civil rights laws and regulations is required.
  • Demonstrated ability to conduct impartial, well-organized, and trauma-informed investigations independently and with sound judgment. Experience in discrimination, harassment, or sexual misconduct matters in a higher education environment is preferred.
  • Experience in and awareness of the sensitivity required when interacting with and addressing the needs of a diverse community on sensitive topics.

ADDITIONAL SKILLS, KNOWLEDGE, AND ABILITIES

  • Knowledge of best practices as they relate to compliance with Title IX is preferred.
  • Ability to manage an ongoing and complex caseload.
  • Superior critical thinking skills demonstrated by the ability to analyze information, evaluate results, and facilitate resolution of difficult situations, including the ability to handle issues of complexity and extreme sensitivity;
  • Exceptional ability to write, communicate, and operate under pressure and tight deadlines with accuracy and professionalism.
  • Ability to maintain effective interpersonal working relationships with an ethnically and culturally diverse campus community is required.
  • Ability to work independently, yet function within a team.
