Senior Counsel, Commercial and Compliance

This position is posted by Jobgether on behalf of a partner company. We are currently looking for a Senior Counsel, Commercial and Compliance in the United States.

This is a high-impact legal leadership role supporting the commercial launch and ongoing commercialization activities of a clinical-stage biopharmaceutical organization operating in a fully remote environment. You will act as a strategic legal advisor to Commercial and Medical Affairs teams, shaping how innovative therapies are responsibly brought to market. The role combines hands-on legal work with broader compliance program development, ensuring business initiatives are both effective and fully aligned with healthcare regulations. You will play a central role in enabling launch readiness, supporting cross-functional execution, and balancing legal risk with commercial ambition. The position requires strong judgment, business fluency, and the ability to operate in a fast-moving, evolving biotech setting. You will also contribute to building scalable compliance frameworks that support long-term organizational growth and regulatory integrity. This is a highly visible role reporting to senior legal leadership with direct influence on strategic decisions.

Accountabilities:
  • Serve as the primary legal advisor to Commercial and Medical Affairs teams, providing day-to-day and strategic guidance on business initiatives.
  • Support commercialization readiness, including launch planning, market access strategies, patient support programs, and distribution models.
  • Draft, review, and negotiate a wide range of commercial agreements, including vendor contracts, speaker programs, advisory boards, and sponsorship arrangements.
  • Lead legal review of promotional and medical materials through MLR/PRC processes, ensuring compliance with applicable regulations.
  • Advise on compliant interactions with healthcare professionals, patients, payors, specialty pharmacies, and government entities.
  • Guide commercial and medical activities such as scientific exchange, advisory boards, grants, and medical information requests.
  • Design and implement a scalable healthcare compliance program, including policies, training, monitoring, and reporting frameworks.
  • Oversee transparency reporting and aggregate spend compliance processes.
  • Identify legal and compliance risks and develop practical, business-oriented mitigation strategies.
  • Monitor evolving healthcare regulations and industry standards, translating them into actionable guidance for leadership.
  • Support broader corporate legal and business development initiatives and manage external counsel relationships.
  • Contribute to building and strengthening an agile, high-performing legal and compliance function.
Requirements:
  • Juris Doctor (J.D.) degree and active bar membership in at least one U.S. jurisdiction.
  • 8–12+ years of legal experience, ideally within biotech or pharmaceutical environments (in-house strongly preferred).
  • Proven experience supporting commercial product launches and commercialization activities.
  • Strong expertise in healthcare compliance laws and regulations, including FDA, OIG guidance, Anti-Kickback Statute, False Claims Act, PhRMA Code, and Sunshine Act.
  • Hands-on experience with MLR/PRC review processes and promotional regulatory frameworks.
  • Demonstrated ability to draft and negotiate complex commercial agreements.
  • Experience building or scaling compliance programs in a regulated life sciences environment.
  • Strong strategic thinking, risk assessment, and problem-solving capabilities.
  • Excellent communication and stakeholder management skills across cross-functional teams and executive leadership.
  • Ability to thrive in a fast-paced, high-accountability, and evolving organizational environment.
  • Leadership mindset with a pragmatic, solution-oriented approach and strong ethical judgment.
  • Willingness to travel up to 10% as required.
Benefits:
  • Competitive base salary range: $250,000 – $285,000 USD, based on experience and location
  • Eligibility for annual incentive plans tied to individual and company performance
  • Comprehensive benefits package including medical, dental, vision, and 401(k) retirement plan
  • Paid time off and standard employee leave benefits
  • Fully remote work environment with flexibility across the United States
  • Opportunity to shape commercial launch strategy in a high-growth biotech setting
  • Exposure to cross-functional leadership and high-impact strategic decision-making
  • Supportive environment focused on building scalable legal and compliance systems.
