Product Counsel, ERISA & Operations

This role sits at the intersection of retirement benefits law, product development, and operational execution within a high-growth fintech environment focused on expanding access to retirement savings. You will act as a key legal advisor embedded within both customer-facing and product teams, translating complex ERISA and IRS regulations into practical, scalable guidance. The position plays a critical role in ensuring that automated systems, payroll integrations, and plan administration workflows remain compliant while supporting innovation. You will help shape how retirement products are designed, launched, and operated in a highly regulated environment. This is a highly cross-functional role requiring close collaboration with engineering, operations, and product leaders. It offers the opportunity to directly influence how retirement benefits are delivered to millions of employees while ensuring legal rigor and operational excellence.

Accountabilities:
  • Serve as the primary ERISA subject matter expert for internal customer-facing teams, providing real-time legal guidance on plan administration, fiduciary duties, and compliance matters.
  • Advise on complex retirement plan issues, including EPCRS corrections, disclosure requirements, participant communications, and plan sponsor obligations.
  • Review and guide ERISA-compliant development of participant-facing materials, disclosures, and automated system-generated communications.
  • Act as the ERISA legal partner for product teams, translating regulatory requirements into actionable product guidance and design constraints.
  • Evaluate product features and workflows to ensure compliance with ERISA fiduciary standards, prohibited transaction rules, and IRC qualification requirements.
  • Support cross-functional decision-making by synthesizing legal, operational, and product considerations into clear recommendations.
  • Monitor regulatory, legislative, and case law developments affecting qualified retirement plans and translate them into internal policy updates.
  • Develop and maintain internal legal guidance, playbooks, and training materials to ensure consistent application of ERISA requirements across teams.
Requirements:
  • 5–8 years of substantive ERISA experience focused on qualified retirement plans (401(k), 403(b), IRAs), including at least 2 years in a law firm environment.
  • Deep expertise in ERISA fiduciary duties, prohibited transaction rules, and IRS qualification requirements.
  • Proven experience supporting operational compliance, including EPCRS correction processes and real-time plan administration guidance.
  • Ability to advise non-legal teams in fast-paced environments, translating complex legal analysis into practical business actions.
  • Strong experience working with product, operations, or technology teams in a cross-functional advisory capacity.
  • Excellent written and verbal communication skills, with the ability to produce clear, decision-grade legal documentation.
  • Active bar admission or equivalent authorization to practice law in a U.S. jurisdiction.
  • Bonus: Experience in-house at a recordkeeper, TPA, fintech, or trust company, or exposure to fiduciary models such as 3(16), 3(21), or 3(38) arrangements.
