Description:
This attorney will be the lead on all aspects of the ETCH contracting process, from drafting physician contracts to reviewing and negotiating contracts with vendors and other third parties. The attorney will also be responsible for ensuring compliance with federal and state laws and regulations and for auditing contracts for compliance.

Minimum Education: J.D.
Degree: J.D.
License/Certification Required: Licensed to practice law in Tennessee
Minimum Work Experience: 3-5 years
Experience with physician and other health care contracting
Basic knowledge of Healthcare Law in general
Must be detail-oriented and able to work with a variety of stakeholders
Familiarity with hospital or healthcare operations a plus
Manage the physician contracting process including:
Prepare and negotiate physician contracts using established templates and compensation models
Ensure compliance with federal and state law, including Stark, the Anti-Kickback Statute, HIPAA, and CMS regulations and provide guidance to internal stakeholders on these requirements
Audit physician payments for compliance with contracts
Review, draft, and negotiate other contracts including but not limited to vendor agreements, business associate agreements, clinical affiliation agreements, and leases
Provide guidance on contract disputes and contract enforcement issues
Stay abreast of laws and regulations affecting healthcare contracts
Work with Legal Services Coordinator to maintain contracts database and insure integrity of contract review process
Collaborate with internal stakeholders including Legal Services, Finance, Operations, Compliance and Risk
Frequent sitting with some walking, standing, squatting, bending and reaching is required. Frequent keyboard/computer use is required.
