Description:
Key Responsibilities
1. Tender & Contract Review
Review tender documents and identify contractual, commercial, and legal risks.
Conduct comprehensive risk assessments and propose mitigation strategies.
Evaluate tender terms related to scope, liability, delivery schedules, LD/penalties, warranties, payment terms, and dispute mechanisms.
Provide structured recommendations to management based on risk exposure and suitability.
2. Cross‑Functional Coordination
Liaise with internal departments such as Engineering, Projects, Purchase, Finance, Quality, and Legal to gather inputs on tender conditions.
Consolidate all departmental feedback into unified tender responses.
Facilitate internal review meetings to ensure alignment of commercial and technical positions.
3. Contract Drafting & Documentation
Review customer and vendor contracts to ensure compliance with company policies and project requirements.
Draft and issue contract-related letters including:
Extension of Time (EOT) requests
Delay and disruption notices
Hindrance records
Change order/variation requests
Claims and counterclaims
Maintain proper documentation to support contractual positions. Ensure timely submission of notices as per contract requirements.
4. Dispute Resolution & Commercial Negotiations
Participate in dispute resolution proceedings such as negotiation, mediation, or arbitration support.
Coordinate with legal counsel and project teams for preparing claims/defence documentation.
Support commercial discussions with clients and suppliers to resolve contractual issues or finalize agreements.
Key Skills & Competencies
Strong understanding of contract law, commercial terms, and industry standards.
Expertise in reviewing tenders, contracts, and complex agreements.
Excellent drafting and communication skills.
Ability to identify risks and propose practical mitigation measures.
Proven experience in handling claims, delays, EOT, and notices.
Strong negotiation and stakeholder management abilities.
Ability to work independently and manage multiple tenders/projects simultaneously.
Qualifications
Bachelor’s degree in Engineering, Law, Business Administration, or related field.
MBA or LLB/LLM preferred (optional as per company requirement).
Professional certifications in contract management (e.g., IACCM/WorldCC) would be an added advantage.
Preferred Industry Experience
EPC, Construction, Infrastructure, Manufacturing, Engineering Services, Power, Oil & Gas, or Heavy Equipment sector.
